QUESTION NO. 11

QUESTION: Councillor A.M. Dermody

"To ask the Manager to bring this Committee up to speed as to where matters are since I first brought the request to the Manager back in May 2013, asking the Manager on behalf of the Scouts located on Marian Road to extend their land holding to facilitate the expansion of the scouts to allow for better facilities, which in turn would allow for the children currently on a waiting list to be included as members.  There was legal uncertainty as to whether or not the Council is the owner of the land and/or whether or not the Manger had the legal capacity to extinguish/lease the additional land to the Scouts?"

REPLY:

The following report was presented to the November 2013 Area Committee Meeting;

The Ballyroan Scouts 14th Troop requested a meeting with the Council to discuss a proposal to extend the area of their current building plot into the adjacent open space.  The purpose of this proposal would be to allow for enhanced activities to be undertaken in larger Den area.  A meeting was arranged and a discussion on the idea was held.  Following this the Troop provided some information to the Council on their land ownership. 

Whilst the proposal is regarded as a good one the Council cannot enter into an arrangement with the club at present that involves the transfer of an area of the open space. The reason for this is that the open space, whilst is has been maintained by the Council for over 25 years, the title to the land itself has not been legally transferred.

The Council is currently endeavouring to pursue the transfer of title.

A further report will be presented to the Elected Members on progress in the matter.

It is the intention of the Council to progress the matter and to report on progress to a future Area Committee meeting.
