MOTION NO.12

MOTION: Councillor M. Corr

That the Manager explains/outlines how enforcement may take place under the Litter Pollution Act when a resident of a property fails to produce proof of disposal of waste and to consider targetting systematically areas within Tallaght that may be considered problematic in terms of dumping.

REPORT:

The Litter Pollution Act 1997, as amended, makes no provision for the seeking of information from private individuals as to how  household waste is disposed of.

However,   Part 11 , General Obligations, Section 5 of  SDCC Household Waste Bye-Laws 20l2 provides as follows:

"Where a householder disposes of household waste at an approved wasste facility, the householder is required to retain and produce on request by the Local

Authority , receipts for aperiod of one year in respect of such authorised disposal of waste".

In the year to date, a total of l37 Notices pursuant to Section 5 of SDCC Household Waste Bye-laws 20l2 have issued countywide, of which a total of 57 notices issued in the Tallaght area.

The Council's Enforcement and Licensing Division continues to monitor acute illegal blackspots throughout the county and where it appears there is a recurring practice of illegal dumping of household waste,   Section 5 Notices  issue to the residents of  estates in close proximity to the site of illegal dumping for purpose of alerting  all residents of their obligations to legally dispose of their household waste.   

Where evidence of illegal dumping is found  following interrogation by the Council's Anti Litter Warden Team,, appropriate enforcement action pursuant to the provisions of the Litter Pollutin Act, l997 is actively pursued.

Proposals are in hand for installation of covert CCTV at an acute litter blackspot in the West Tallaght area in ongoing efforts to curtail illegal dumping in the general vicinity.
