REFURBISHMENT OF DRESSING-ROOM FACILITY AT DRUMFINN AVENUE PARK, BALLYFERMOT, D20

Refurbishment of dressing-room facility at Drumfinn Avenue Park, Ballyfermot, Dublin 20 for Ballyfermot De La Salle GAA Club - Approval of Declaration in favour of the Minister for Transport Tourism and Sport
The Ballyfermot De La Salle GAA Club has advised the Council that it has been approved by the Department of Transport, Tourism and Sport for sports capital funding in the sum of €70,000 and top-up funding of €21,000 from the Department of Community, Rural and Gaeltacht Affairs, towards the cost of refurbishing a dressing room facility in 'The Gaels Field' which is located on lands owned by the Council at Drumfinn Avenue Park, Ballyfermot. The Council has agreed to allow the Club the use of the lands under licence.
A condition of the payment of the grant monies requires the Council, as registered owner of the property, to complete a Declaration in favour of the Minister for Transport, Tourism and Sport to ensure the continued use of the facility as a sports facility for a period of fifteen years. In the event of it not being used for sporting purposes, all or part of the grant must be repaid.
In accordance with Section 66 of the Local Government Act, 2001, the Council may approve the granting of any 'financial assistance whether by grants, loans, guarantees or other financial aid, lands or other structures etc' for matters of this nature, such approval to be by way of resolution of the Council. The above definition would include completing a Declaration to accept a charge against Council property in respect of funds provided by other parties for facilities constructed thereon.
Accordingly it is recommended that the Council adopt the following resolution:
'That subject to the provisions of Section 66 of the Local Government Act, 2001, the Council completes a Declaration for the benefit of the Minister for Transport, Tourism and Sport to ensure the continued use of the dressing room facility at Drumfinn Avenue Park, Ballyfermot, Dublin 20 (property as shown outlined in red on attached Indicative Drawing No. PLS 1746-01) for sports/ recreational purposes only for a period of fifteen years from the date of payment of the grant and in the event of it failing to do so, to repay all or part of the grant monies in the sum of €91,000 or such further sum as may be made available to the facility from state funds from the Sports Capital or RAPID Programmes, on a reducing scale over time'.
