MOTION NO. 18

MOTION: Councillor E. Ó'Broin

That this Committee supports development of a scheme to facilitate the transfer of small portions of Council lands that;

- Have become hot spots for illegal dumping

- Have become hot spots for anti social behaviour

- Have become badly overgrown with trees & shrubs

- Are no longer accessible to Council staff or the general public

- Have little or no commercial value

The scheme could include an opinion from estate management on the issues outlined above with respect to a specific piece of land; a commitment from the applicant to cover the costs of any construction work arising from the transfer; a commitment from the council to dispose of the land for a nominal fee and to waive legal costs.

REPORT:

The Council has a long established history of disposing of such areas to adjoining householders.  Each application is considered on its own merits.  In each case the area to be disposed of, is valued and this valuation must be paid by the individual acquiring the land.

The Council is obliged to obtain the best price reasonably obtainable for any land/property disposed of.  However in cases such as those instanced in the Motion,the Council's Valuer is made aware of all the circumstances pertaining to the application in order that it may be taken into account in the valuation of the land.  The Council must also be mindful of the cost of transferring title to the land in terms of legal and valuer's fees and it is normal practice to seek to recover these costs from the purchaser.
