Proposed disposal of plot of land to the Victory Christian Fellowship, Killininny, Firhouse Road, Tallaght, Dublin 24
South Dublin County Council on the 29th September, 2004 made a Compulsory Purchase Order entitled 'South Dublin County Council Compulsory Purchase (Firhouse Road Improvement Scheme – Old Bawn Road to Scoil Carmel) Order 2004'. The Council confirmed the Order without modifications on 13th January, 2005. Notice to Treat was served on 20th April, 2005. The Council took possession of Plot 24 on 3rd May, 2006.
The Councils valuer negotiated terms for the payment of compensation to The Victory Christian Fellowshipfor the acquisition of Plot 24 identified in the Compulsory Purchase Order. Agreement was reached to settle the claim at €178,000 (one hundred & seventy eight thousand euro) subject to terms, which included the transfer back to the Victory Christian Fellowship of any lands not required by the Council following completion of the Road Scheme for a nominal sum of €100.00 (one hundred euro). Those lands are identified on the attached drawing number SRD87-100-01 having an area of 0.2261 hectares or thereabouts.
While surveying the lands the Council's Roads Department has now identified a small area outlined in red on attached Drawing No. SRD87-100-02 having an area of 0.0007ha or thereabouts which was omitted from the lands which were compulsory acquired and on which an ESB box and light pole have been erected. It is proposed to acquire this area of land as part of finalising the overall agreement.
Accordingly, I recommend in accordance with Section 211 of the Planning and Development Act 2000 and subject to the provisions of Section 183 of the Local Government Act , 2001, that the Council transfer the lands identified and outlined in red on drawing number SRD87-100-01 having an area of 0.2261 Ha, to The Victory Christian Fellowship in accordance with the forgoing report, and the acquisition of 0.0007Ha or thereabouts as outlined on drawing number SRD87-100-02 in order to complete the agreement between South Dublin County Council and The Victory Christian Fellowship in relation to the acquisition of lands to facilitate the construction of the Firhouse Road Improvement Scheme.
The lands being disposed of form part of the lands acquired by South Dublin County Council from the Victory Christian Fellowship in respect of the Compulsory Purchase Order for road improvement works at Firhouse Road.
