DRAFT LITTER BYE-LAWS

At the Environment SPC November 2012 meeting, it was agreed to commence the process of preparing Bye-laws for the Prevention and Control of Litter for the County. Members of the SPC held a special meeting on 8th January 2013 to discuss issues relating to the Bye Laws including where litter accumulates, types of litter, litter generators and occupier responsibility. At the May 2013 meeting, draft Bye-laws were agreed.
In accordance with Part l9 of the Local Government Act 200l, Section 200 the procedure for making of the Bye-law commenced. Notice of the making of the bye-laws appeared in the local press and www.sdcc.ie on 10th July 2013 with the draft bye-laws available for inspection by the public up to and including the 9th August 2013. Section 200 further provides for a further 7 days - up to and including 16th August - following the final date of inspection by the public within which submissions to the draft bye-laws can be made by the public. No submission were received.
A report on the process was presented to the Environment SPC at its meeting on 2nd September 2013 and it was agreed that the draft Bye Laws for the Prevention an control of Litter 2013 be presented to the Council for adoption.
These Draft Bye-Laws for the Prevention and Control of Litter 2013 are now presented for consideration.
It is a reserved function of the County Council to make/review Bye Laws in accordance with provisions of S 200 of the Local Government Act 2001. The Council may now make the bye-law either in accordance with the draft or subject to such changes as the local authority may at its discretion determine or the Council may decide not to make the bye-law.
It is recommended that the following resolution be passed:
That South Dublin County Council makes Bye-laws in relation to the Prevention and Control of Litter in accordance with the draft bye-laws as published, and that the bye-laws shall come into force on such date as specified in the bye-law, which is not less than 30 days after its making.
In accordance with Section 202 of the Local Government Act 2001 notice of the making of the bye-laws and of the place where copies of the bye-law may be purchased or inspected shall be published in the Iris Oifigiúil and in one or more newspapers circulating in the area to which the bye-law relates.
