PART 8 REPORT ON THE PROPOSED GRANGE CASTLE BUSINESS PARK CENTRAL CARRIAGEWAY LAYOUT
REPLY:
Report on Public Consultation Procedure Under Part VIII of the Local Government (Planning and Development) Regulations 2001-2012 for the Proposed Central Carriageway in Grange Castle Business Park.
Introduction:
Part 8 of the Local Government (Planning and Development) Regulations 2001 – 2012 outlines the requirements with regard to certain classes of Local Authority developments. These regulations apply to the proposed construction of the Central Carriageway Grange Castle Business Park, as described below:
• Construction of 550m of 9m wide single carriageway road.
• Construction of cycletracks, footpaths and verges.
• Provision of drainage and associated features.
• Provision of public lighting, road markings and signage.
• Relocation of services where necessary.
• Provision of other services and utilities where necessary.
• Provision of landscaping finishes.
• All associated site works as necessary to complete the scheme.
The proposed scheme involves the construction of a central access carriageway with associated drainage and utility services to serve industry within the Grange Castle Business Park.
Consultation Process:
The proposal for this scheme was advertised in accordance with the requirements of Part 8 of the Local Government (Planning and Development) Regulations 2001 – 2012 on the 8th May 2013 in the public press. Plans and particulars of the proposed scheme were on display and available for inspection or purchase in the offices of South Dublin County Council, County Hall, Tallaght, Dublin 24; South Dublin County Council, Civic Offices, Clondalkin, Dublin 22 from Wednesday 8th May 2013. Submissions and observations with respect to this matter, dealing with the proper planning and sustainable development of the area in which the development would be situated were sent to the SEO, Corporate Services, South Dublin County Council, County Hall, Tallaght, Dublin 24. The closing date for the receipt of written submissions / observations was on Wednesday 3rd July 2013.
A presentation pertaining to the particulars of the proposed development was also made to the Clondalkin Area Committee Meeting on the 15th May 2013.
List of persons or bodies who made submissions or observations with respect to the proposed development:
3No. Observation(s) / Submission(s) were received as follows:
1. Ms. Noreen O'Sullivan, Property Management Branch, Department of Defence, Station Road, Newbridge, Co. Kildare.
2. Ms. Yvonne Dalton, Head of Planning, Dublin Airport Authority plc, Dublin Airport, Co Dublin.
3. Mr. Tom Prendergast, Principal Environmental Health Officer, Environmental Health Officers Department, Block E Westland Park, Willow Road, New Nangor Road, Dublin 12.
Summary of the issues raised:
1. Ms. Noreen O'Sullivan, Property Management Branch, Department of Defence, Station Road, Newbridge, Co. Kildare.
Observations:
The Air Corps would comment as follows:-
The site during construction should be managed to ensure that it does not become a bird attractant.
In landscaping, species should be selected which do not provide additional food sources for birds especially wood pigeon.
Council's Response:
· South Dublin County Council will ensure that the site does not become a bird attractant during construction. Planting associated with the landscaping to accompany the road will be chosen so as not to provide additional food sources for birds.
2. Ms. Yvonne Dalton, Head of Planning, Dublin Airport Authority plc, Dublin Airport, Co Dublin.
Observations:
We the Dublin Airport Authority (DAA), Head Office, Dublin Airport, Co. Dublin, have no comment to make at this time regarding the proposed Grange Castle Business Park Central Carriageway Layout.
Council's Response:
· South Dublin County Council acknowledge the Dublin Airport Authority's lack of objections to the project.
3 Mr. Tom Prendergast, Principal Environmental Health Officer, Environmental Health Officers Department, Block E Westland Park, Willow Road, New Nangor Road, Dublin 12.
Observations:
Their comments are as follows:
(i) This project will cause no loss of habitat area on the identified SACs within a 15km radius.
Council's Response:
· South Dublin County Council acknowledge that the project will cause no loss of habitat in any of the identified SACs within a 15km radius
(ii) There is a slight concern that waterborne pollution from the project could be borne by the Griffen River and impact on the South Dublin Bay SAC. There are precautions suggested relating to best construction practices to control this possible impact. It is recommended that the precautions are more precisely worded, terms like 'where possible' should be avoided, and that the precautions outlined are adopted in full,
Council's Response:
· South Dublin County Council confirm that the precautions outlined in the Screening Statement for Appropriate Assessment relating to prevention of waterborne pollution will be adopted in full.
(iii) The document states that there will be no airborne emission. It is highly unlikely that a construction site will cause no fugitive dust. Perhaps the assessor meant that there would be no aerial emissions of ecological significance. Suitable precautions will be necessary during construction to protect sensitive locations from fugitive dust emissions.
Council's Response:
· South Dublin County Council confirm that suitable precautions will be put in place to during construction to protect sensitive location from dust emissions.
(iv) The document refers to the storage of construction materials away from drainage ditches. A waste management plan will be required to supplement such storage plans.
Council's Response:
· South Dublin County Council confirm that a waste management plan will be in place prior to the commencement of the works.
(v) The noise management plan will presumably follow at a later stage. Management of nuisance noise from such construction sites is largely obtained by restricting hours of operation.
Council's Response:
· South Dublin County Council confirm that the construction will take place during normal working hours. Where the nature of the work necessitates works being carried out outside of normal hours this will only be with the prior agreement of South Dublin County Council.
(vi) It is noted that the light pollution management is to be obtained by working during daylight hours; this obviously means working through the nesting season.
Council's Response:
· South Dublin County Council acknowledges the concerns of the Environmental Health Officer's Department in relation to works being carried out during the nesting season.
(vii) The conclusion of the report is that the site is of low ecological significance and shall not impact on the SACs identified in the 15km radius. Therefore a Stage 2 AA is not required. The HSE has no reason to dispute this finding.
Council's Response:
· South Dublin County Council acknowledges that the HSE has no reason to dispute to findings of the Screening Statement for Appropriate Assessment and a Stage 2 Appropriate Assessment will not be needed.
(viii) I request that items 2 – 6 listed above receive consideration for South Dublin County Council prior to the development of the project, however there are no objections from the HSE to the development.
Council's Response:
· South Dublin County Council acknowledges that the HSE has no objections to the development.
Recommendation:
This report is submitted in compliance with the recommendations of the Planning & Development Act, 2000 and Part VIII of the Planning and Development Regulations 2001-2012. The various works proposed under the Central Carriageway Grange Castle Business Park are in accordance with the 2010 – 2016 County Development Plan and with proper Planning and Development of the area.
It is proposed to proceed with the scheme as advertised.
