QUESTION NO. 14
QUESTION: Councillor E. Tuffy
"To ask the Manager for an updated report on the taking in charge of Rossberry Estate, Lucan and in particular to advise the Committee if issues to do with the construction of front garden walls by a number of residents have been, or are being resolved?"
REPLY:
In respect of the question pertaining to the removal of walls, there were eight seperate properties subject of enforcement action involving construction of unauthorised walls. In six properties the walls have been removed. In one case the walls are to be removed by July 31st. In one case the walls are not yet removed and are subject of ongoing action.
Until the Council can obtain unfettered access to all public services the estate cannot be taken in charge.
In respect of the completion of remaining items, the Council has sequestered almost €11,000 of the developers security deposit to complete taking-in-charge related works and has obtained consent from the receiver to complete these works prior to taking in charge. Procurement is ongoing at present.
The receiver is also engaged with the Councils Parks Dept to achieve the transfer of open space to the Councils ownership and has submitted legal documents for review by the Councils Law Dept.
Ongoing maintenance will however remain the receivers responsibility until all services are taken in charge and again this cannot occur until the remaining walls are removed.
