MOTION: Councillor T. Delaney
That this Committee calls on the Manager to enforce the removal of commercial bins which are permanently sited on the pavement in the Clondalkin Village area.
REPORT:
South Dublin County Council Bye-laws for the Storage, Separation at Source and Presentation for Collection of Commercial Waste Bye-laws 2007 came into operation on the l2th December 2007.
Section 3 of the Bye-laws, paragraph 3 (ff) defines "prescribed place"
"in relation to a commercial premises means a convenient place immediately outside the entrance to such premises or as close as practicable to the entrance, but not a place which would cause an obstruction to users of a roadway, footway or footpath". Paragraph 3.6 of the Bye-laws further provides " the Council may designate in writing a specific collection point, other than a prescribed place, for the presentation of waste by the holder and, where such designation is given, the older shall only present waste for collection at the designated collection point".
Contact will be made by the Council's Litter Warden Service in consultation with SDCC Roads Department with the owners of the commercial bins sited on the pavement in Clondalkin Village with a view to enforcing the provisions of Section 3 of these Bye-laws relating to the Presentation of Waste.
