MOTION: Councillor P. Kearns
That this Council with the aid of a report on (1) How many fines were issued (2) how many posters were removed, discuss what further action can be taken in relation to the huge increase in illegal postering in the county
REPORT:
During the period January to April 2013 a total of 111 Fixed Penalty Notices (OSF) pursuant to Section 28 of the Litter Pollution Act l997 in relation to illegal signage issued within administrative area of SDCC. In the case of serial litter polluters, it is the policy of this Council to pursue direct prosecutions proceedings pursaunt to Section 25 of the Litter Pollution Act , which proceedings carry a higher financial penalty if convicted through the courts. Recent prosecutions have proved successful in courts with convictions secured.
Illegal signage where the signage impinges on the visiblity of safety of the Council's network of roads and footpaths are removed by the Council's Roads Department.
The Council's Enforcement and Licensing Division has and continues to actively enforce the provisions of the Litter Pollution Act l997 in relation to illegal signage and other offences under the Litter Pollution Act and Waste Management Acts, l996, as amended.
