MOTION NO.5

MOTION: Councillor C. Brophy

That this Council condemns the practice of illegal commercial postering and that the Manager reports on what prosecutions and fines have been levied for illegal postering throughout the entire county in the last few months. Can the Manager also provide details on what percentage of these fines have been paid and or prosecutions for non payment  issued. 

REPORT:

During the period January to April 2013 a total of 111 Fixed Penalty Notices (OSFs) pursuant to Section 28 of the Litter Pollution Act, l997  have been issued in relation to illegal signage in South Dublin County Council's administrative area.  Of this,  a total of 42 fines have been paid to date.  No prosecutions have yet been taken against any of these alleged pollutors, as in general it takes approximately 4 months for an unpaid fine to come before the courts.. 

In the period January to April 2013 a total of 11 fines were referred to the courts for prosecution, 4 convictions were secured and 7 paid their fines just prior to the court date.  These results are from Fixed Penalty Notices fixed penalty notices issued for illegal signage in 2012.
