SECTION 85 AGREEMENT UNDER THE LOCAL GOVERNMENT ACT 2001 WITH KILDARE COUNTY COUNCIL
a) REPAIRS TO SEAN WALSH FOOTBRIDGE (N81)
b) REPAIRS TO PEDESTRIAN FOOTBRIDGE OVER THE M50 IN THE VICINITY OF THE NATIONAL BASKETBALL ARENA
REPLY:
1.0 Introduction
The National Road Authorities Regional Bridge Manager for Leinster who is employed by Kildare County Council and is based in the National Roads Office in Kildare has identified the need to carry out rehabilitation works on the following structures;

1. KE-M09-056.00 Hillsborough Road Bridge
2. KE-M07-039.00 Maudlings Interchange Bridge
South Dublin County Council
3. SD-M50-016.00 National Basketball Arena Footbridge
4. SD-N81-004.00 Sean Walsh Memorial Footbridge
Dunlaoghaire/Rathdown County Council
5. DR-M11-004.40 Shankhill Overbridge
6. DR-M11-004.00 Ballybride Road Footbridge
Wicklow County Council
7. WW-N11-060.00 Kilmacanogue Footbridge
Westmeath County Council
8. WH-N06-001.00 Athlone Bridge
2.0 Proposal
It is proposed by the National Roads Authority to replace expansion joints, waterproofing and resurfacing on the two bridges located in the Administrative Area of South Dublin County Council under a single works contract for the following reasons:-
a) Considerable cost savings would be made if all works were carried out under a single works contract i.e. economies of scale.
b) Considerable cost saving would be made in design and procurement as only one Tendering process would be required as opposed to three for a contract let by the three individual Local Authorities
c) There would be considerable time savings as a consequence of only having to go through a single tendering process and only having to assess a single contractor for the role of Project Supervisor Construction Stage.
d) There would be considerable time savings as a consequence of only having to assess a single Consultant for the role of Project Supervisor Design Process. This appointment will be made by the lead Authority, Kildare County Council.
It is the view of the National Roads Authority that Kildare County Council are best placed to Administer this contract. The NRA Regional Bridge Manager, who is also the Project Manager for this scheme, is an employee of Kildare County Council and is based in the National Roads Office of Kildare County Council.
It is recommended that the Council enter into AGREEMENT with Kildare County Council in accordance with the provisions of Section 85 of the Local Government Act 2001, whereby Kildare County Council will carry out these works.
