"That this Area Committee requests the Manager to present a detailed report on the status of the taking-in-charge of open spaces in Lucan estate, including at:

In relation to the above:

Access road to Rossberry, Tullyhall & Haydens Park

The following report was presented to the February 2013 Lucan Area Committee Meeting.

In the case of Rossberry/Tullyhall the Council is still awaiting some of the required documentation, has been in correspondence with the respective developer representatives and has stressed the need for these matters to be addressed as a matter of urgency.  In order to expedite this process the Council has also recently (January 2013) made contact with the receiver for the Developer firm.

In relation to a date for the completion of the transfer of the lands to the Council the sooner that all of the required documentation has been supplied by the developer representatives the sooner the matter can be brought to a conclusion.  However, it should be stressed that even when all of the documentation has been received there is often a long time period in which the processing of the material takes place and this process involves, inter alia, legal and land registry processing.  The Council has been proactive in following up with the respective developers and will continue to do so.

Since the meeting the Council has been in contact with both the Receiver for the developer firm for Rossberry as well as the Solicitor firm representing the Receiver. 

Update

In relation to Rossberry/Tullyhall, documentation relevant to the legal transfer has now been supplied by the Receiver.  The Council is currently examining this documentation and, subject to the documents being in order, the Council's Development and Law Departments will proceed to arrange to have full transfer and registration of title completed. The Council will assume responsibility for the maintenance and upkeep of the lands once this process has been completed.

Griffeen Glen Courtyard and Boulevard

All of the documentation in relation to Griffeen Glen Courtyard has now been received and is currently being processed through the Council’s Development and Law Departments.

Ash Park

The Council met on site with the Developer of Ashpark some years ago to examine the areas intended to be transferred to the Council.  However, there were a number of discrepancies in the areas to be transferred and the Developer was requested to rectify these matters before submitting a Deed of Transfer. When this matter has been attended to and the full set of documents required by the Council have been provided, the taking in charge process can proceed.  The Council will arrange to make contact with the Developer to expedite the process.

Hansted

The Council is at present in discussion with the representative of the Developer in relation to the entire Hanstead development including the open spaces.

The Elected Members will be updated on developments with the above.
