QUESTION: Councillor D. Looney

"To ask the Manager for an update on legal proceedings, contact with the owner and other changes relevant to the McHugh's site, St James' Rd/Limekiln Avenue, and to make a statement on the matter?"

REPLY:

The High Court proceedings in respect of the levy demand applied pursuant to the provisions of the Derelict Sites Act l990  were struck out in December 20l2  with a payment of €1,500 accepted from the defendants representatives as a contribution towards the Council's costs.  The land in question is privately owned and a check of SDCC records show that no planning application has been submitted at this time.  The owners are required to secure and maintain the site pending future development.
