MOTION NO. 10

MOTION: Councillor T. Ridge

That a report be brought as to the continuous dumping on both private and public grounds at rear of Coldcut Club and rear of adjoining housing estates. Reply to include what measures this Council can provide to remove same.

REPORT:

A request was received from Samildanach GAA Coldcut Club in relation to allegations of illegal dumping within the grounds occupied by Samildanah G.A.A. Coldcut club under lease from the owners.   As the lands in question are in private ownership, SDCC has no responsibility in relation to the maintenance of these lands.  Further, the Council's Litter Warden has reported that the litter is not visible from a public place so therefore is not enforceable under the  Litter Pollution Act l997. Samildanach G.A.A. Coldcut Club is advised to pursue  the matter of clean-up and ongoing maintenance of these privately owned lands under the terms of the lease agreement entered into between the Club and owners of the lands in question.

Lands in public ownership in the vicinity of the Coldcut Club will continue to be monitored by the Council's Litter Warden and where evidence of illegal dumping is found, appropriate enforcement action will be taken under the Litter Pollution Act l997.  Members of the public are actively encouraged to report all incidences of illegal dumping and littering to SDCC Enforcement and Licensing Division where all such reports will be actively pursued by the Litter Warden for the area.

The Council's Cleansing Section has been requested to schedule a clean up of  public lands under maintenance of SDCC in the immediate vicinity of the Coldcut Club and  to the rear of adjoining housing estates.
