QUESTION: Councillor T. Gilligan

To ask the Manager to outline bonds outstanding in 2011/2012;  bonds not extended and why in 2011/2012;  also broken down into the respective local areas?

REPLY:

In respect of the question above it should be noted that in the last four years particularly, actions by the Council in pursuit of claims on bonds have contributed to the completion of works and the taking in charge of over 30 estates in the county. The categories outlined in the question would in practical terms relate to those bonds that the Council has placed claims upon and is pursuing. In a significant number of cases, either the developer, receiver or bond company have completed or are completing taking in charge related works or are in the process of agreeing the works with the Council.  The list below for the County outlines the estates and the status of works/claims in the affected cases:

SD03A/0320 Arena, Whitestown Way, Tallaght Bypass Claim lodged and being pursued with insurance company. CCTV being carried out to finalise costs.
SD03A/0857, SD06A/0434 Citywest Plaza Claim on bond, permission extended and condition restated. Revised bond being provided. Proposal from developer for completion of open space is with Law Dept.
S95A/0546 Verschoyle Minor works remaining. Development to be advertised for taking in charge March 2013 
Sd04A/0579 Hunterswood All public services except open space is taken in charge. Claim being negotiated on open space, with costings on boundary treatment the remaining issue.
SD04A/0798 The Presbytery, Cookstown Road Claim lodged owing to failure to provide playground
SD04A/0222 Boden Park, Ballyboden, Dublin 16. Claim lodged and works almost completed to taking in charge standard, CCTV awaited
S01A/0186 Aras na Cluaine Claim lodged for limited footpath works
S98A/0349,   S00A/0426, S99A/0108, SD03A/0559 Larkfield  Being advertised for taking in charge March 2013
S00A/0907 Mount Bellew  Being advertised for taking in charge March 2013
SD02A/0427 Fortfield Square Part private development. Developer conducting review of landscaping, public lighting, pumping station etc to complete to taking in charge standard
SD05A/0274 Tullyhall, Lucan, Co. Dublin Development commenced and stalled. Bond required for future closings of sales to occur. Enforcement case being prepared. 
S98A/0567 Rosberry Enforcement case, unauthorised walls to be removed and deed of transfer for open space being processed. Development may then be taken in charge.
S01A/0664 Hansted Bondholders contractor on site completing taking in charge works following claim. Scheduled for completion March 2013
SDZ04A/1 Castlegate, Adamstown, Lucan Bond recently reduced following review of underground services and landscaping requirements. Taking in charge package being prepared by developer,
SD06A/0590 Cornerpark, Newcastle, Co. Dublin Claim lodged and developer notified that future sales cannot proceed without bond. Costings to be finalised to pursue claim or obtain extended bond.
SD03A/0421 Belgard Sq. West, Cookstown Way, Tallaght Claim lodged and receiver has been assembling CCTV to finalise all  works, tender almost complete pending outcome of CCTV
SD02A/0275 Belgard Sq.,Tallaght Town Centre, D24 Claim lodged and receiver has been assembling CCTV and inspecting site to finalise works in agreement with SDCC.
S01A/0423 Esker Manor Claim lodged relating to playground and compliance proposal pending from developer.
SD04A/0936 Aylmer Heath Claim lodged and CCTV received to initiate process of costing all taking in charge works
SD06A/0107 New Bancroft Bond in place during construction and house sale period. Site stalled and bond not renewed. Developer advised to put bond in place and that further sales of units would not be possible without same. Enforcement case being prepared.
