MEETING OF RATHFARNHAM AREA COMMITTEE

Tuesday, March 12, 2013

HEADED ITEM NO. 19

Ballyroan House Lodge

Future Potential Uses:
Ballyroan House Lodge is located in an area zoned for residential development, but is subject to a specific objective in the Development Plan relating to the Council's Record of Protected Structures. As such the potential future uses relate to those consistent with the zoning of the site as set out in the Development Plan. This could be achieved through the reinstatement of the property consistent with maintaining the character and special interest of this protected structure. Given the scale of the site and its location and access potential, a modest extension could be considered provided such an extension proposal respected or reflected the character and special interest of the structure through the use of appropriate material or design.

Enforcement:
Section 59 Endangerment Notice dated 26th October 2012 was issued to the owner in respect of this Protected Structure. This set out the required works to be carried out by the owner in relation to safeguarding the Protected Structure, considered by the Planning Authority to be endangered. There is an obligation on the owners of Protected Structures to safeguard these structures which are part of our collective heritage and to prevent endangerment. The property was subsequently inspected to determine compliance with the notice. It was found that the notice had not been complied with, and it was recommended that further legal proceedings be initiated.  The process to initiate such proceedings is currently underway.
