MOTION NO.3
MOTION: Councillor G. O'Connell
"As a follow up to Motion No 5 at the November Lucan ACM , in support of the good work done by Cllr Tuffy on this matter and reflecting the frustrations of the residents, that the Manager provide an update on the progress that has taken place since the November meeting in relation to the procuring the additional material connected with the Deed of Trust transfer for Rossberry/Tullyhall so that the taking in charge of the piece of land/roadside on Griffeen Ave and entrances to Haydens Park and Tullyhall Estates can be completed and to ask the Manager to give the meeting a firm date by which this matter can be concluded and the piece of land brought into Council ownership and maintained to a satisfactory standard."
REPORT:
The following reply was presented to the Lucan Area Committee Meeting on the 27th November 2012:
Documents in relation to the Deed of Transfer for both areas have been received from the relevant developers. The Griffeen Glen Courtyard material is currently being processed through the Council’s Development and Law Departments.
In the case of the Rossberry/Tullyhall area the solicitors acting for the developer have been requested to supply additional material in order for the processing of the Deed of Transfer to take place and it is expected that these will be provided shortly.
In relation to the taking-in-charge of Rossberry/Tullyhall, the Council is still awaiting necessary documentation. The Council has been in further correspondence with the developer and his representatives and has stressed the need for these matters to be addressed as a matter of urgency.
The Council is not in a position to give a firm date for the completion of the transfer of the lands to the Council as this is dependant on the Developer submitting the necessary documentation to enable the Council to proceed. Council staff are in ongoing contact with the developer and his representatives in relation to these outstanding matters. In the meantime, there is an obligation on the developer to maintain the area until such time as it has been formally taken-in-charge by the Council.
