MOTION: Councillor D. Looney
That this Committee asks for a report on planning enforcement on lands at 192 Whitehall Rd, Dublin 12, including a full case history of the site, and that this Committee discuss such a report.
REPORT:
Following representations alleging unauthorised development on the subject site, a Warning letter was served on the owner/occupier of the lands on 2/12/2011 regarding the sale of domestic fuel type products without the benefit of Planning Permisson.
The lands were monitored, and following inspections, an Enforcement Notice was served on 5/09/2012 which required that within the specified period commencing 7th September 2012 and ending 5th November 2012 that the following stepsbe taken by the landowner:
(i) Remove the timber shed and steel container from the lands.
(ii) Remove the advertising sign rising over the wall of the site addressing Whitehall Park, with text referring to “Solid Fuel Store, Coal, Briquettes and De-icing Salt”, from the lands.
(iii) Close the vehicular access to the lands from Whitehall Park and re-instate the boundary wall.
Following a further inspection of the lands on 15/11/2012, additional unauthorised development was found to be taking place. Accordingly, a further Warning Letter was served on the owner /occupier regarding the following :
1. The use of the subject lands for the storage and sale of domestic fuel products to members of the public.
2. The erection of an advertising sign, white in colour and with text referring to “Solid fuel store, coal, briquettes and de-icing salt”, on the corner wall of the site visible from both Whitehall Road and Whitehall Park.
3. The erection of two flagpole signs with flag advertisement, red in colour with white” open” text, rising over the boundary wall of the statement site addressing Whitehall Road and Whitehall Park.
As a person served with a Warning Letter, the owner/occupier may make submissions within a four week period ending 28/12/2012. This submission period is in accordance with the requirements of Section 152 of the Planning and Development Act, 2000 (as amended).
It was also noted during an inspection of the lands that a freestanding ‘sandwich board’ type advertising sign, displaying “store open” text and the price of coal, turf, kindling, fire logs, firelighters, and hardwood and softwood logs, has been positioned on the public footpath along the side boundary of the site. This matter has been referred to the Litter Warden for investigation and action.
A planning application was received on 26/11/2012 for the following proposed development under Reg. Ref. SD12A/0240;
Retention of vehicular entrance and gates, steel container, steel shed, 2 no. flagpoles and signage and continuance of use of lands for the purpose of selling fuel.
A decision is due on this application on or before 29th January 2013.
