MOTION NO. 15

MOTION: Councillor J. Lahart

"That this committee requests the Manager's response to the decision of An Bord Pleanala to overturn this Council's grant of planning to SD12B/0056 and to make a statement on the matter."

REPORT:

The Planning Authority’s decision was to grant permission having considered the particulars of the proposed development and taking into consideration the existing site history.  The Bord is required to consider any appealed proposed development as if the application was made to them in the first instance. The Bords decision is final.  

 In this particular case, the Bord have overturned the decision made by this planning authority. This can happen in a minority of cases decided by the Bord.

An Bord Pleannala decisions and their implications for assessing future similar proposed developments are taken into consideration by this Planning Authority. However, given the very specific circumstances relating to this proposed development, the wider implications for future policy are limited.
