Cad É an beartas maidir le haraidí bruscar atá tréigthe ag féachaint ar dhualgais na gcuideachta dramhaíola faoin Acht um Thruailliú Bruscar 1997?

What is the Council's policy regarding abandoned litter wheelie bins having regard to the duties of waste companies under the Litter Pollution Act 1997? 

REPLY:

Tá ceist araidí bruscar a chur ar fáil agus a bhailiú mar chuid don chonradh idir an táirgeoir bruscair (An Sealbhóir Tí) agus an bailitheoir ceadaithe bruscair.  Nuair a chuireann an sealbhóir tí críoch lena conradh le comhlacht príobháideach dramhaíola, tá an dualgas ar an sealbhóir tí teagmháil a dhéanamh leis an gcomhlacht agus iarraidh orthu an t-araid bruscair a bhailiú.  Nuair a chuireann an sealbhóir tí an comhlacht ar an eolas, tá an dualgas ar an gcomhlacht an t-araid bruscar a bhailiú taobh istigh d’am réasúnta. 

Tá gearáin faighte agus fós a bhfáil ag CCáCT trí Sheirbhís Mhaoir Bhruscar an Chomhairle Ón bpobal faoi araid tréigthe trasna an chontae.  Is cosúil, Ó bhreathnú ar na ngearáin, go bhfuil comhlacht amháin ar leith nach bhfuil ag bailiú an araid bruscar nuair atá deireadh curtha le conradh ag an gcustaiméir.  Bhí Rannóg Cur i bhFeidhm agus Ceadúnais Ó Sheirbhísí Comhshaoil i dteagmháil leis an gcomhlacht.

The  matter of the issue/removal of a wheelie bin forms part of the private contract  between the waste producer (the householder) and the Authorised Waste Collector.  Where a householder discontinues their contract with a private waste  company,  the onus is on householder to contact that company and request that the redundant wheelie bin be removed.  Once the householder notifies the waste company,  it is the responsibility of that company to remove the wheelie bin within a reasonable time.

SDCC has and continues to receive complaints from members of the public and through the Council's Litter Warden Service regarding the ongoing issue of abandoned wheelie bins throughout the county; analysis of these complaints would suggest one company in particular is failing to respond to request form former customers to have redundant wheelie bins removed.   The Council's Enforcement and Licensing Division, Environmental Services has contacted the company in question in relation to the ongoing problem.
