QUESTION: Councillor G. O'Connell

"To ask the Manager for an update in relation to the piece of waste land between Nos 14 and 16 The Lawns Palmerstown and why has a response not been sent to the Hon Secretary of Palmerstown Court Residents Association on the matter?"

REPLY:

The Council acquired the plot of land in question some years ago by way of Deed of Waiver from the Minister for Finance as the Company who owned the land had been dissolved. The land contains significant public services and therefore requires to be accessible to the Council for maintenance purposes. Following representations from and on behalf of local residents to the Minister for Finance at the time, a condition was included in the Deed to the effect that the Council would secure the area by provision of a wall and gate. However this work was not undertaken at the time as discussions were ongoing with the owners of the adjoining properties at 14 and 16 Palmerston Lawn who wished to incorporate the area into their gardens.

Initially terms were issued to both houseowners to enable them to incorporate and maintain the area on foot of a caretakers agreement. This agreement provided that the houseowners would be responsible for building the necessary wall and timber panel fencing to effectively divide the plot into a front and rear garden area to be used in connection with the existing houses, while at the same time reserving access to the Council. Subsequently the houseowner of  No. 14 did not proceed to take up this option and terms were issued for a licence of the entire area to the houseowner of No 16. It now appears that this houseowner does not wish to take up this option. Once this position is clarified with the houseowner, the Council will make arrangements to secure the area by provision of wall and gate as soon as resources permit.
