Riparian Owners on the Owendoher River
The Legal Department of South Dublin County Council (SDCC) was asked about the SDCC’s responsibilities with regard to the maintenance of riverbanks and they have stated that they “confirm that local authorities do not have any legal obligation to repair land adjacent to a river which it does not own.”
The lands owned by SDCC on the Owendoher River between where it flows into the Dodder River in Rathfarnham and Ballyroan Road are shown on the attached map and number three plots.
Plot A was included in the Scheme of Transfer of Lands from the Corporation & is registered to the Council on Folio 3226
Plot C – are the lands fronting the Owendoher Estate in Rathfarnham. The Owendoher Estate was included in the Scheme of Transfer of Houses from the Corporation. The Corporation forwarded details of the lands to be transferred as part of this plot / estate, the open space & the western bank of the river was included on this map. These lands are not registered in Land Registry.
Plot D – the Council hold a Deed of Dedication in respect of these lands. The lands were dedicated to the Council by Tiernan Homes ltd in 1982 – they are the public open space requirement for the adjoining Boden Wood development.
