QUESTION: Councillor W. Lavelle
To ask the Manager to confirm if this Planning Authority is to discontinue the practice of granting temporary planning permission for takeaways in residentially-zoned areas in light of the decisions by an Bord Pleanala (PL06S.236907 & PL06S.239707) to refuse two such temporary permissions granted by this planning authority?
REPLY:
Any valid planning application made must be determined by the planning authority.
With respect to takeaways there is no general policy regarding temporary permissions. All decisions on applications are made on a case by case basis and the planning authority cannot pre-judge any application.
In assessing a planning application the planning authority will assess it in the light of County Development Plan policies; site history; An Bord Pleannala decisions, where relevant; interdepartmental reports and taking into consideration any third party representations made. In the event of a grant of planning permission the planning authority will attach any conditions it considers appropriate in the interests of the proper planning and sustainable development of the area.
