QUESTION NO. 9

QUESTION: Councillor W. Lavelle

"To ask the Manager for an update on residents’ previous request to secure implementation of Specific Local Objective 25 of the County Development Plan 2010-2016, i.e. to "facilitate completion of the boundary fence that separates Bewley Grove and Mount Bellew Way running eastwards as far as the Outer Ring Road” and to include a new pedestrian entrance in the railings (and footpath across the green area) at the northern end of Bewley Grove?"

REPLY:

There are a number of tasks that need to happen before Specific Local Objective 25 of the County Development Plan 2010-2016 can be implemented.  One of these tasks is the extinguishment of the existing right of way.  The procedure to extinguish a public right-of-way is a reserved function of the Elected Members of the Council in accordance with Section 73 of the Roads Act 1993.  While a significant amount of work has been done on this, it is important to note that the loss of this link would have a detrimental impact on the permeability within the area and discommode school children and parents who use this route to travel to the local primary school.  In addition closing this link is likely to result in damage to the existing hedgerow and fences as residents endeavour to continue to travel between the estates to avoid longer journeys. For this reason it is important that alternative links are created.
