MOTION NO. 4

MOTION: Councillor T. Gilligan

That the Manager brings a headed item to the Council to dispose of land at 45-57 Lealand Drive to the residents on Anti Social Behaviour grounds.

REPORT:

A request to dispose of a plot of land to the rear of a block of houses at 49-57 Lealand Drive has been examined previously approximately 2-3 years ago. The area of  land is substantial but does not line up symmetrically with the boundaries of the five properties in question thus making the sub-division of the plot more difficult. The plot also contains existing hedgerow with trees which would be disturbed if the plot is subdivided.

As the houses are a mix of purchased and rented properties, the matter was referred to the Housing Department for investigation and to ascertain if any other measures could be put in place to counteract the alleged anti-social behaviour at this location. The Housing Department has indicated that it has no plans to carry out any works at this location at the present time.

Accordingly, it is now proposed to prepare maps showing a sub-division of the plots between the five adjoining  properties. The disposal of the land will be dependent on the residents of all of the affected properties agreeing to the sub-division of the land and any terms or conditions attaching thereto.

In the case of the purchased houses, a formal legal transfer of title will be required and the householders will be responsible for all costs involved in the acquisition and sub-division of the plot.
