That the Manager by way of a report to this Committee will outline what actions can and have been taken in relation to litter not being collected in private shopping centre car parks in the Clondalkin EA and what are the responsibilities of shopowners on this problematic issue?
REPORT:
The Litter Wardens inspect private shopping centre car parks on a regular basis, with more focus given to these areas at the weekends taking into account the increase and likelihood of take away litter in these particular areas etc. It is the responsibility of the shop owners/occupiers to keep the area surrounding their premises litter free at all times.
If an area is not seen to be litter free, notices have issued in accordance with Section 16(1) of the Litter Pollution Act 1997 to the relevant shop owners/occupiers to have the area cleared of all litter. The notice states "the local authority may, by notice served on the occupier, require the occupier to take such measures at the premises or on land in the vicinity thereof as the local authority considers necessary to prevent or limit the creation of litter and provide for its removal". These notices issue to owners/occupiers on a continuous basis. If they are not adhered to, the Litter Warden will then make a recommendation for the next relevant enforcement action, to ensure the areas become and remain litter free.
