QUESTION NO. 3

QUESTION: Councillor P. Cosgrave

"To ask the Manager to give an update on condition 2 of the planning permission of the development at 73 Dargle Wood?"

REPLY:

Under Register Reference SD11B/0029 (ABP PL06S.238758), planning permission was granted, subject to conditions, by An Bord Pleanala on the 18th August 2011 for the following development at 73, Dargle Wood:

"Retention of existing shed for use as office/playroom."

Condition No. 2 of the permission granted states:

"Within two months of the final grant of planning permission, the roof and rainwater goods to the rear elevation of the shed to be retained shall be modified accordingly to ensure that no part of the structure encroaches or over-sails the adjoining properties to the site."

Following receipt of complaints in relation to alleged non-compliance with the above condition, a Warning Letter pursuant to Section 152 of the Planning & Development Act 2000 (as amended) issued to the Owner on the 2nd November 2011.

An investigation was carried out and it was found that the roof of the shed did not oversail or encroach on adjoining properties. Accordingly, as Condition 2 of the grant of permission has been complied with, there is no further action available to the Planning Authority in the matter and the file has been closed.
