To ask the Manager to outline the regulations governing the erection/(tying/hanging/nailing etc) of banners/posters/hoardings on buildings/poles/railings/walls/roofs/fences/vehicles on a temporary or semi-permanent basis?

REPLY:

The Regulatory provisions governing the erection of temporary signage are set out in Section 19 of the Litter Pollution Act 1997 and Section 71 of the Roads Act 1993.

In summary, the legislation prohibits the erection of signage on any structure or on any land where permission for the signage has not been given by the owner of the land, be it public or private property. The erection of such signs is an offence and Local Authorities are empowered to issue fixed penalty notices (fines), prosecute offenders and/or remove signage as appropriate where permission for the erection of the signage cannot be proven. In cases where the safety of road users is threatened, the offending sign will be removed immediately in the interests of public safety. In such cases the costs of recovery and storage can be recovered from the owner of the sign.

Environmental Services and Roads Department work closely on the enforcement of these powers where necessary.
