MOTION NO. 2.
Motion: Councillor M. Devine
That the Manager give a report on what action(s) can be taken in the case of semi or abandoned homes that are not Council stock but attract anti-community behaviours that seriously disrupt and cause misery to surrounding neighbours
REPLY:
Anti-social behaviour on privately owned land is a matter for the Garda Siochana and the owner of that property.
If a vacant and unsecured site is seen as a potentially dangerous or derelict place, the Council has powers under Dangerous Building (Local Government Sanitary Services Act 1964) or Derelict Sites legisalation to take action to remove such danger/derliction.
These powers range from the issuing of Notices requiring the undertaking of remedial works, the carrying out of works and recovery of costs, prosecution for non-compliance or seeking of court orders to compel compliance and ultimately the compulsory acquistion of the sites in question.
