MOTION NO. 25

MOTION: Councillor W. Lavelle

"That this Committee requests the Manager to present a detailed report, for discussion, on outstanding taking-in-charge processes relating to areas of open space in residential estates in Lucan, including in particular the open space at Rossberry Estate including the area along the access road from Griffeen Avenue."

REPORT:

The developer whose responsibility it is to effect the transfer of the open space at this location has been written to by the Council in January 2012.  This letter informed him of the Council’s position on the matter and that the cash security remaining from the completion of the outstanding works in the development will be returned on the completion of the Deed of Transfer.

The developer has confirmed in writing to the Council his intention to proceed with completing the Deed of Transfer in this manner.  The Council continues to press the developer to complete this process in the shortest possible timeframe.

The Elected Members will be updated on the matter.

Griffeen Glen

The solicitors acting for the Developer have been in contact with the Council and are in the process of assembling the required information to effect the Deed of Transfer of the open spaces to the Council.  The Council has been in contact with the Developer and has indicated that the Council will take the open spaces in charge once the Deed of Transfer has been fully completed.  The Council has also reminded the Developer that it is the responsibility of the Developer firm to continue the maintenance of the open spaces until such time as the Council assumes responsibility for them.
