MOTION NO 15

MOTION: Councillor M. Devine

That the Manager give a report on what action(s) can be taken in the case of semi or abandoned homes that are not Council stock but attract anti-community behaviours that seriously disrupt and cause misery to surrounding neighbours.

REPORT:

Anti-social behaviour on privately owned land is a matter for the Garda Siochana.  If a vacant and unsecured site is seen as a potentially dangerous or derelict place, the council can write and request a check from the Property Registration Authority to establish ownership and any alternative address for the owner(s) or responsible person(s) i.e. a financial institution if repossessed.

The council can then write to the owner(s) or responsible person(s) asking that the property be secured against damage or trespass.  If the site is deemed to be dangerous, a Notice under the Sanitary Services Act can be issued by the Council’s Dangerous Places section at Architectural Services Department.  If the site is deemed to be derelict or potentially derelict, a letter requesting works be done or a Notice under the Derelict Sites Act as deemed appropriate can be issued by the Council’s Environmental Services Department.
