Update on the TASC pavilion in Tymon Park
REPLY:
The Council has taken every opportunity to advance the construction of a sports pavilion, known as the TASC Pavilion, on the Limekiln side of Tymon Park. The Council completed a Part 8 proposal for the project and successfully applied for Sports Capital Funding for the project with the support of the TASC group (Tallaght Athletic Sports Club) a group comprised of a number of local sports clubs, who were encouraged to combine into a single group for the purposes of this project. Detailed architectural drawings were prepared and tenders were advertised in 2011 for the construction of the pavilion and a suitable contractor was identified to undertake the work.
However, work cannot commence on the project until such time as the legal issues concerning the Deed of Covenant and Charge, required by the Department of Transport, Tourism and Sport, have been resolved by the Chief State Solicitor's Office (CSSO). A condition of the payment of the grant monies requires the Council, as owner of the land to enter into a Grant Agreement and a Deed of Covenant and Charge with the Minister for Transport, Tourism & Sport to continue to use the facility for community/sporting purposes for a specified period of up to fifteen years and in the event of it failing to do so, to repay all or part of the grant on a reducing scale.
This Deed of Covenant and Charge is to be registered as a burden against the Council’s title to enable the draw down of grant monies up to a value of €700,000. The Council holds registered title to the land under Folio no. DN36250F. This includes the adjacent car park area at Limekiln which will provide the car parking requirements for the changing room facility. A report on the Deed of Covenant and Charge was presented to the April 2011 Council Meeting and noted by the Elected Members.
As the CSSO is a separate entity, the Department of Transport, Tourism and Sport is unable to give a definite timeframe for the resolution of the legal matters. They have, however, requested that the CSSO deal with the matter as quickly as possible. Once the legal issues have been resolved, the Council will endeavour to move the project forward as quickly as possible, having regard to the financial resources available at that time. The Council will continue to liaise with both the Chief State Solicitors Office and the Department of Transport Tourism and Sport in the matter.
Representatives from the Parks and Landscape Services Section have recently met with representatives of the TASC group to update them on progress with the project. The Elected Members and the TASC group will be kept informed and updated on developments.
