MOTION: Councillor W. Lavelle
"That this Committee recommends that the Manager now seek to rescind the land-swap agreement approved by Councillors in November 2006, in which this Council was to dispose 41.5 acres of land at Balgaddy/Kishogue to Shelbourne Developments in return for 42.56 acres of land at Cooldrinagh."
REPORT:
The Council at its meeting on the 13th November 2006 noted a proposal to dispose of 41.50 acres approx. of land at Balgaddy, Clondalkin to Shelbourne Development Ltd in exchange for 42.56 acres approx. at Cooldrinagh, Leixlip subject to certain terms and conditions, Minute No. C/0619/06 refers. The Council has entered into the relevant legal agreements in respect of same.
The ownership of the lands at Cooldrinagh has passed to the Council on foot of this approved agreement. Planning permission for a mixed use development on the Balgaddy lands was granted on 24th Febuary 2011 following appeal to An Bord Pleanala. SD09/0149.
Legal and commercial elements of the terms and conditions contained in the above agreement remain outstanding and are the subject of negotiations involving the Councils Valuer, the Law Agent and other parties. Whilst it is not possible to comment further at this stage members will be informed on the resolution of negotiations.
In any agreement in relation to property disposal/transfer/exchange ,following approval of the members and the relevant contracts being entered into, it would not generally be in the Councils interests to seek to rescind such agreement.
