MOTION NO. 16

MOTION: Councillor T. Gilligan

That this Committee calls on the Manager to examine the possibility of adjusting the garden size to provide more open space at 1A, St. Patrick Road,  and to provide an outline of the cost to date and into the future.  

REPORT:

At its meeting held on 8/5/2006, the Council noted a  proposal in accordance with Part 8 of the Local Government(Planning and Development ) Regulations 2001 -2005, to construct a single four bedroom, two storey detached house on a site adjacent to 1, St. Patrick’s Road, Clondalkin, Dublin 22 and the construction of a new 1.8m high stone wall plus capping between Michael Collins Park and St. Patrick’s Estates for a distance of approximately 130 metres and the construction of a 600 mm high stone wall and railing between these two estates and fronting onto Ninth Lock Road for a distance of approximately 30 metres and all necessary associated ancillary works.

With regard to the cost incurred to date by the Council on the construction of the wall/house , the Parks Department had  brought a proposal  to the Lucan/Clondalkin Area Committee Meeting (2) on 24th June, 2003 relating to the building of a wall between the two estates to aid the reduction of anti-social behaviour at this location, which was approved under the Parks Works Programme 2003.

 During the detailed preparation for the construction of the wall it was decided that the presence of services in the open space lands in question would require such foundations and ancillary works to be undertaken that the cost implications would render the construction of the wall no longer feasible.

 It was subsequently decided that the elimination of the anti-social behaviour could equally be eliminated by the construction of a house adjacent to No. 1 St. Patrick’s Road. The monies raised from provision of the house were  to be used towards the cost of construction of the boundary walls referred to above. The plot of the house and garden forms part of the overall solution to this issue and was agreed as part of the Part 8 process. Variations to the boundaries would lead to considerable expense in moving of walls and would not add significantly to the available open space in this location.

 The final cost of the contract for the construction of house and wall at this location was in the sum of €563,759.00. Other miscellaneous expenditure including fees etc has brought the total expended by the Council on this project to date to €583,924.  As the members will be aware, the Council are pursuing the acquisition of a strip of land included in the site from the original developers and it is not yet known what expenditure is involved in this transaction. In the event that title to strip of land is resolved, the Council would hope to be in a position to recoup some of the cost from the future sale/letting of the house.
