QUESTION: Councillor B. Lawlor
"To ask the Manager what action the Council are taking against a shop trading illegally at *Details supplied. This illegal shop opens after 5.00 pm to frustrate possible inspection and will the Manager confirm that this illegal shop will be closed immediately under the powers vested in the Council relating to planning enforcement?"
REPLY:
As the dwelling in question is the property of the Local Authority, enforcement action under the Tennancy Agreement in place is more appropriate than that under the planning enforcement provisions of the Planning and Development Act 2000 (as amended).
In this regard, the Housing Department have interviewed the tenant in relation to alleged trading from the house, and have warned the tenant in relation to such continued activity. If this activity persists serious action will be taken against the tenant in accordance with his tenancy.
Housing Department staff will be regularly monitoring and following up on the matter.
