QUESTION: Councillor M. McDonagh
To ask the Manager further to his response to Question No 4 at the 15 February 2012 Clondalkin Area Committee and in light of the persistent illegal dumping at the location to provide an update on the request from the resident of (address supplied), to have the derelict land at the rear of his house incorporated at a nominal fee to the Council on the understanding that the resident will undertake the cost of all works relating to the incorporation.
REPLY:
Terms were issued in February 2011 to the owners of the property referred to in relation to the disposal of portion of laneway at the rear of the property for the sum of €450.00 plus VAT (if applicable) together with payment of Council's legal and Valuer's fees in the matter.
The Council is obliged to obtain the best price reasonably obtainable for any land /property disposed of, however in cases such as the above the Council's Valuer is made aware of all of the circumstances pertaining to the application in order that it can be taken into account in the valuation of the property. The Council also has to be mindful of the cost to the Council of transferring title to the land/ property in terms of legal and Valuer's fees and it is normal practice to seek to recover these costs from the Purchaser.
In view of the length of time which has passed since the initial valuation was prepared, the Chief Valuer has been requested to review the position. On receipt of his report further contact will be made with the owners of this property to discuss the matter further.
