MOTION NO. 2
MOTION: Councillor M. Corr
That the Manager arranges for immediate inspection of lands in Council ownership to the rear of St Aidan's Traveller Accommodation adjacent to the new Luas stop at Fortunestown and to the rear of Kilmartin Estate in Fettercairn alongside the Luas tracks with a view to ascertaining if these lands are in breach of any legislation relevant to Planning and Development.
REPORT:
Environmental Services Department have arranged to carry out an inspection of the areas in question.
The Anti Litter Warden has confirmed that the rubbish to the rear of Kilmartin Estate alongside the Luas tracks has been removed during the course of the road works that are ongoing there.
The Anti Litter Warden also confirmed that there is a substantial amount of horse manure to the rear of St. Aidan’s Residential Caravan Park. Reports are sent regularly to Environmental Services Department who are responsible for actions under the Control of Horses Act, to alert them if there are horses in the area so that action can be taken by the contractor to remove them.
He also confirmed that there is some burnt waste and litter to the rear of St. Aidan’s Residential Caravan Park. He could find no evidence of where the waste originated and so is unable to issue fines or initiate court proceedings. The Environmental Services Department will continue to monitor this area in an effort to establish the identity of those who are dumping.
Within St. Aidan’s R.C.P. six of the bays are currently occupied. Three of the bays have been vacated and they been blocked up to secure them. One of the bays has been surrendered recently.
As all residents are responsible for the disposal of their household waste, a letter has been sent to all residents of Traveller Specific Accommodation reminding them of their obligation under the terms of their tenancy agreement to dispose of household waste correctly. They have also be requested to provide evidence of which Household Waste Collection Service Provider they have signed up with.
A further letter will issue reminding all residents of St. Aidan’s Residential Caravan Park once again that they are not allowed to keep horses in their bays or in the surrounding areas.
Reports from the Planning and Development Departments indicate that there are no actions available under the Planning Acts.
As part of ongoing management of our traveller specific accommodation, Traveller Accommodation Unit will arrange for the removal of any waste, to the rear of St. Aidan’s R.C.P. The District Park Supervisor has confirmed that the manure is not suitable for use by Parks Department therefore it has been arranged that the manure will be removed and disposed of in the coming days.
