QUESTION: Councillor W. Lavelle

To ask the Manager, further to the discussions on my motion at the March meeting, if the planning authority will agree to issue a warning letter to the owner/developer of the Hermitage Clinic regarding the provision of public access to lands along the River Liffey, handed over to South Dublin County Council as part of the Clinic development, in line with the requirements of the Council and the conditions of the Bord Pleanála decision PL 06S.128044, noting that it is currently not possible to access this land due to the configuration of the road system provided by the hospital and the standard of road and pedestrian access constructed?

REPLY:

An Bord Pleanála decision on the Hermitage Clinic PL06S.128044 included condition no.2 which states;

'Prior to commencement of development, rights of way for future public access and maintenance shall be provided and dedicated to the South Dublin County Council between the public road at the roundabout and the lands to be transferred to the South Dublin County Council in accordance with details indicated on drawing number 2465-PL02 received by the planning authority on the 9th day of November, 2001.'

This right of way has been dedicated to the Council and has been submitted to the Property Registration Authority for registration. The right of way is a legal burden of title on the relevant lands. This Planning Authority has issued compliance on this condition in early 2005. Having regard to the foregoing, enforcement is not considered necessary
