QUESTION NO. 25
QUESTION: Councillor M. McDonagh
To ask the Manager, with respect to the answer to Question No. 17 at the Area Committee Meeting on February 15 2012, would the Council consider transfer of land at rear of (Address Supplied) for the purposes of reducing anti-social behaviour at that site, for a nominal fee to the tenant at said address and if the tenant in question was willing to cover the cost of any construction work?
REPLY:
Terms have been issued to the houseowners of the property at Rowlagh Crescent in relation to a plot of land at the rear to straighten the rear boundary.
The Council is obliged to obtain the best price reasonably obtainable for any land /property disposed of, however in cases such as the above the Council's Valuer is made aware of all of the circumstances pertaining to the application in order that it can be taken into account in the valuation of the property. The Council also has to be mindful of the cost to the Council of transferring title to the land/ property in terms of legal and valuers fees and it is normal practice to seek to recover these costs from the Purchaser.
It is proposed to make further contact with the houseowners in this case to discuss the matter and to establish if any options can be devised which would meet with the requirements of both parties.
