QUESTION: Councillor T. Gilligan

To ask the Manager, can a Property Agent in the Clondalkin EA introduce clamping as a way for people to pay their management fees?  If you have not paid your fees then you are not issued parking permits therefore, your car is clamped and one is fined.  Do they need planning permission for this and is it legal?

REPLY:

Payment of management fees and operation and management of parking spaces/permits, within private areas by Management Companies is not a matter for the Council. In the event that such companies may wish to introduce such changes they should obtain their own legal advice.

In the event that any signage is to be erected in respect of such changes/fee structures etc., planning permission may be required, depending on the size and other factors relating to the erection of such signage, relevant information in relation to exemptions relating to signage etc are in the Planning and Development Regulations 2000, Schedule 2, Part 2 “Exempted Development – Advertisements”.
