HEADED ITEM NO. 7c) (i)

REVISED DISPOSAL OF LAND AT MAYFIELD PARK, CLONDALKIN, DUBLIN 22 FOR PROVISION OF AN ESB SUB-STATION.

At its meeting held on Monday 12th September 2005 the Council noted the recommendation to dispose of a plot of land comprising an area of circa 9 sq. m. in respect of the proposed development of 36 dwellings at Mayfield Park, Clondalkin, Dublin 22, to the ESB for provision of an ESB substation.

Following completion of the development a re-measurement of the area to be disposed of was carried out by the Council's Architectural Services Department.  The revised area of land to be disposed of as outlined in red on the amended attached drawing (OS Sheet No. 3261-25) comprises an area of circa 5.28 sq.m. and has been agreed by the ESB by letter dated 19th January 2011.

Accordingly, it is recommended that the Council proceed to dispose of its interest in the plot of land comprising 5.28 sq.m. as shown on drawing (OS Sheet No. 3261-25) to the ESB in order to facilitate the supply of electricity to the overall completed development subject to the following conditions:-

1.  That this plot of land be transferred freehold and free of charge to ESB for the provision of an electricity sub-station in accordance with the terms and conditions of the agreement for the supply of  electricity to the development at Mayfield.

2. That the ESB will contribute €572.00 towards the cost of the Council's legal fees, VAT and reasonable outlay in relation to the disposal.

3.That the normal condition of a disposal of this nature will apply.

I recommend that this disposal be proceeded with subject to the aforementioned conditions.
