Proposed disposal of land at Old Court Mill, Tallaght, Dublin 24 for the provision of an ESB Sub-Station
The Council acquired 40 no. dwellings from Ellier Developments under Part V Agreement at Old Court Mill, Tallaght, Dublin 24.
In order to facilitate the supply of electricity to the development, it was necessary to install an ESB Sub-Station at the site. Ellier Developments omitted to dispose of the land for the Sub-Station to the ESB prior to the land passing into the ownership of South Dublin County Council.
The location of the Sub-Station has been agreed with the County Architect and access to the Sub-station site will be via the existing public road network.
The area of land to be disposed of is as outlined in red on attached drawing (OS Sheet No. 3453-03) comprising an area of circa 12.16 sq. m.
It is recommended that the Council dispose of its interest in the plot of land comprising 12.16 sq. m. of thereabouts as shown on OS drawing no. 3452-03, at Old Court Mill, subject to the following conditions:-
- That this plot of land be transferred freehold and free of charge to ESB for the provision of an electricity sub-station in accordance with the terms and conditions of the agreement for the supply of electricty to the development at Old Court Mill.
- That the ESB will contribute €750.00 towards the cost of the Councils legal fees, VAT and reasonably outlay in relation to the disposal.
- That the normal condition for a disposal of this nature will apply.
The land is registered within Folio No. DN1036F to South Dublin County Council.
Subject to the provisions of Section 183 of the Local Government Act, 2001, as amended, and in accordance with Section 211 of the planning and Development Act, 2000, I recommend that this disposal proceed.
