Amendments to the Draft Fortunestown LAP
REPORT:
The current stage of the Amendments to the Draft Fortunestown LAP is as follows
a) the amendments have been on display from the 10th January to the 6th February 2012
b) a series of submissions on the amendments have been lodged and
c) the Manager’s Report on the submissions was circulated to the Elected Members on the 5th March 2012. The Managers Report contains a number of recommendations in relation to the submissions.
Submissions
A total of 18 written submissions were received during the statutory consultation period and these can be broken down as follows: Prescribed bodies 8, landowners 5, residents/residents associations 4 and 1 from a T.D.
The principal concerns of the submissions are as follows;

It should also be noted that the Manager’s Report also includes the Report on the Environmental Aspects of submissions received on the Proposed Material Alterations to the Draft Fortunestown Local Area Plan and the Appropriate Assessment Screening Report on submissions under Proposed Material Alterations to Draft Fortunestown Local Area Plan.
Manager’s Recommendations
The substantive amendments recommended as a response to the submissions are as follows;
Amend the Proposed Material Alteration by reinserting the requirement to complete a fully operation District Park to the rear (south-west) of Citywest Shopping Centre with outdoor play and recreational facilities as part of Phase One in Table 8.2 under Alteration Ref. No. PA44.
Omit flood risk mapping from Figure 4.4. (Alteration Ref. No. PA02). Amend text under Section 4.9 to refer to availability of flood risk information in the appendices of the Fortunestown Local Area Plan and state that such information should be used to identify sites for detailed site-specific Flood Risk Assessment and appropriate responses at planning application stage in accordance with ‘The Planning System and Flood Risk Management Guidelines for Planning Authorities (2009). Insert flood risk information into appendices.
Include additional text under Alteration Ref. No. PA01 (Section 4.9) to note that serious flooding reportedly occurred in October 2011 at the northern end of the Boherboy lands, Carrigmore Avenue, Carrigmore Green, Citywest Golf Course, Fortunestown Lane (near Saggart Luas stop) and Garter Lane.
Ensure that a minimum of 85% of all dwellings across the Plan Lands be provided as own door houses and that a maximum of 15% of all dwellings across the Plan Lands be provided as apartments/duplexes with such dwellings limited to appropriate areas or particular locations such as Luas stops and landmark junctions and sensitively designed to contribute to the broader aesthetics of the area including the nearby Mountains. The minimum average floor area of all developments throughout the Plan Lands shall be 110 sq. metres.
Amend Objective GI4 under Material Alteration Ref PA06 as follows:
A 10 metre (min) biodiversity strip (measured from the top of the bank and excluding the width of bicycle and footpaths to be provided) shall be maintained on both sides of the sections of watercourse that are designated for preservation under the proposed Local Area Plan, for flood management, landscape and biodiversity reasons. These biodiversity strips shall protect, improve and enhance the natural character of the streams. Pedestrian and cycle corridors shall be provided alongside and parallel to the outer edge of all biodiversity strips where possible (Objective GI4).
A 10 metre (min) biodiversity strip (measured from the top of the bank and excluding the width of bicycle and footpaths to be provided) shall be reserved along both sides of the designated sections of the Corbally Stream for flood management, landscape, biodiversity and heritage reasons including the reinstatement and augmentation of the historic hedgerow boundary recently removed from the western side of the Corbally Stream. This biodiversity strip shall be accompanied by an adjacent and parallel pedestrian/cycle path from the Boherboy Road to the public open space to the north-east (District Park) as part of Phase 1 of development of the Boherboy lands. (Objective BN5a).
Next Stage
It is recommended that the Members of the Clondalkin Area Committee note the recommendations as set out in the Manager’s Report, prior to the full Council meeting on the 16th April 2012.
Following consideration of the Manager’s Report on the 16th April 2012 ( within 6 weeks of receiving the Report), the Fortunestown Local Area Plan comes into force four weeks later, i.e. 14th May 2012.
