MEETING OF CLONDALKIN AREA COMMITTEE

Wednesday, March 21, 2012

MOTION NO. 19

MOTION: Councillor B. Bonner

That the Manager provides an updated report on the situation with regard to the issue of trading from the street in Main Street, Clondalkin.  The latest items to be suspended from the shutters and displayed outdoors for sale are toilet seats and bathroom mats.  These added to the large array of ladies clothing, hula hoops and a multiplicity of other items sway in the wind above the bales of toilet roll and washing powder.  The Easter eggs will no doubt be in situ on the pavement before the date of this meeting and all presided over by shopkeepers on seats on the public pavement.  Is all this in accordance with regulations and if so can it be explained to me again please.

REPORT:

The situation with regard to trading in general on the Main Street in Clondalkin has been monitored on a continuous basis and only minor infringements have been noted. The action open to the Council is under Section 71 of the Roads Act 1993 and verbal warnings have been issued to have goods removed from the pavement. This has proven effective and will be repeated as necessary for all premises in breach of the provisions of the Act. There are no regulations pertaining to the display of goods in the manner referred to in the motion and no action is open to the Council in this regard.
