MOTION NO. 5

MOTION: Councillor D. Looney

That this Council seeks to put in place a regulatory framework for the times and days permitted for the collection of waste in the county, given the difficulties arising in the multiplicity of waste collections since the Council's service was privatised. That this framework will govern all waste collection companies operating in South Dublin County and will be brought for agreement to a monthly meeting of the Council no later than May 2012.

REPORT:

The collection of household waste in Ireland is regulated through Waste Collection Permit System as provided under the Waste Management Acts and Regulations. Until recently, these permits were issued by eight Regional Lead Authorities with Dublin City Council being the Lead Authority for the Dublin Region.

Under the reform programme being inplemented in the Local Government Sector, Offaly County Council, as and from 1st February 2012, now operates the National Waste Collection Permit Office which will issue Permits to Collection Service Providers throughout the country.

As regards regulatory options for this Council, Section 8 of the South Dublin County Council Storage, Presentation and Collection of Household Waste Bye Laws 2007 sets out the requirements for Waste Collection Service Providers in this county. A Review of these ByeLaws is currently under way under the aegis of the Environment SPC. A report recommending that Draft Bye Laws be presented for public display and the initiation of the statutory process was agreed at the meeting of the Environment SPC on the 6th February last and noted at the meeting of the County Council on the 13th February.  The statutory procedure will commence shortly. Members of the public will have the opportunity to make submissions on the draft Bye Laws and Council Members will have the opportunity to input into the Bye Laws during the process.

At the moment, Waste Collection Permit Holders are required under their Permits to comply with relevant legislative and standards requirements and any current Bye Laws applicable in the area of their operation.
