MOTION: Councillor T. Gilligan
That the Manager outline how many fines were given out last year in the Clondalkin area for illegally presented household bins. Does the Manager think it is reasonable to fine customers of Greyhound even though household refuse collection is not the Council's responsibility anymore?
REPORT:
Of 400 fixed penalty notices issued in regard to Waste Bye-Laws in 2011, 198 were issued to addresses in the Clondalkin area.
South Dublin County Council made Bye-Laws pursuant to Section 35(1) of the Waste Management Act, 1996 (as amended) and in accordance with Part 19 of the Local Government Act, 2011. The intention to make these Bye-Laws was advertised in the public press on 15th May 2007. Copies of the draft Bye-Laws were available from the Council’s website, Council offices and libraries until 15th June, 2007 as part of the public consultation process.
On 8th October 2007, following the period for public consultation and having considered one submission received, it was resolved by a meeting of the elected members of South Dublin County Council “That South Dublin County Council makes Bye-Laws under Section 35 of the Waste Management Act, 1996 for the storage, presentation and collection of waste.”
The Bye-Laws in relation to Household Waste were called “South Dublin County Council Storage, Presentation and Collection of Household Waste Bye-Laws 2007”. The Bye-Laws apply to the functional area of South Dublin County Council.
A working group has been established to review the current bye-laws and it is hoped that a report will be presented to the February meeting of the SPC in this regard.
