PROPOSED EXTINGUISHMENT OF THE PUBLIC RIGHT OF WAY OVER LANEWAY BETWEEN NO. 8 AND NO. 10 MOORFIELD CLOSE, CLONDALKIN, DUBLIN 22. MAP REF: RE 0619
The following report was submitted to the Clondalkin Area Committee Meeting on Wednesday 19th October, 2011.
βAn application has been received from the Housing Department and residents of Moorfield Close to formally extinguish the public right-of-way over laneway between No. 8 and No. 10 Moorfield Close, Clondalkin, due to anti-social behaviour and to affect the closure by means of gates.β
Following consideration of the report, it was agreed to initiate the procedure.
The proposal to extinguish the public right-of-way was advertised in the Echo on Thursday 27th October, 2011 and signs were erected on site in accordance with Section 73 of the Roads Act, 1993. The latest date for receipt of objections, representations and requests for an oral hearing was Monday 12th December, 2011.
No submissions received.
Public Lighting - No Public Lighting issues with this proposal.
Water & Drainage Section report β No watermain, surface water sewer or foul sewer implications.
Bord Gais have reported no gas mains inside the site boundary.
Eircom objects as they require access to underground and overhead plant at this location.
UPC no underground services within the area.
ESB have no objections but insist they are contacted before the commencement of any works.
It is proposed to effect the closure by means of the erection of gates at both sides of the laneway .In the event of the Public Right Of Way being Extinguished Eircom can be given a key to the gate to access their services in the laneway.
The decision regarding the extinguishment of a public right-of-way is a reserved function of the Council.
Any recommendation of the Committee will be brought to the attention of the Council.
