Update on disposal of plot of land between 34A Moyville and Palmer Park, Rathfarnham.

The Council at its meeting held on 8th March 2010 approved the disposal of a strip of land adjacent to the property at 34A Moyville Estate to the respective houseowners, up to the extent of its ownership with the boundaries of the properties at 40-47 Palmer Park.  Following discussions at previous meetings of the Area Committee, the disposal of the plot of land in question was deferred as the owners of 34A Moyville had not submitted their proposals to comply with enforcement proceedings issued by the Council’s Planning Department and to deal with the rectification and re-instatement of the boundary with the Palmer Park properties and in particular No. 45 Palmer Park and also provision of suitable treatment to prevent an overspill of surface water onto the Palmer Park properties.

A submission has now been made to the Council by a Consulting Engineer, engaged by the applicants, outlining measures to be taken to address the issues raised in the enforcement notice and confirming that discussions have been held with local residents and local Councillors to resolve any outstanding issues. It is understood that some of the works have since been undertaken. The Consulting Engineer on behalf of the applicants has now requested the Council to proceed with the disposal of the strip of land adjacent to the property in order that the boundary treatment can be finalised and the remainder of the works agreed, can be completed.

It is now proposed that the Council re-instate the offer to dispose of the strip of land adjacent to 34A Moyville Estate to the respective houseowners, Ciaran and Valerie Murray and to proceed with the disposal in accordance with the terms previously approved by the Council at its meeting held on 8th March 2010, Minute No. H7C)/0310 refers.
