MOTION NO. 17

MOTION: Councillor E. Tuffy

That the Manager would consult with the An Garda Síochána authorities regarding the legal basis of the actions implemented by An Garda Síochána to enforce bye-laws and other legal instruments in the administrative area of Dublin City Council to regulate and control the use of locations other than designated Taxi Ranks by taxi drivers seeking passengers on the street in Dublin City, and bring forward proposals, in the form of addenda/amendments to the existing SDCC Parking Bye-Laws or a separate set of Taxi Bye-Laws to regulate and control the use of on street locations other than designated Taxi Ranks in and around Lucan Village, and make an interim report to the December Lucan Area Committee meeting. 

REPORT:

Consideration of the difficulties referred to in the Motion has already taken place in conjunction with the increasing calls for the provision of designated taxi stands (taxi ranks) in a number of locations throughout the County including Lucan Village.

Reference to the overall approach that will be recommended in this regard has been made at recent meetings of the Transportation Strategic Policy Committee and at consultations with stakeholders in relation to the provision of statutory taxi stands.  It has already been stated that it will be necessary to recommend that the Members of the Council adopt a formal set of Bye Laws for this purpose (rather then seek to amend the Pay and Display Bye Laws). When it has been agreed that statutory taxi stands will be approved in the County, a report on the adoption of the necessary Bye Laws for Taxi Stands will be made to a meeting of the Transportation SPC. Members should note that consultations have already taken place on this matter with other authorities including An Garda Síochána and that the adoption of Bye Laws is a reserved function of the Members.
